1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Merchant”, “you”) and PINETECH IT SOLUTIONS PRIVATE LIMITED (“Pinetech ITS”, “we”, “us”, “Coderbunch”) governing your access to and use of the GiftLift: Free Gift Rewards application (“App”) available via the Shopify App Store.

By installing or using the App on your Shopify store, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must immediately uninstall and discontinue using the App.

2. Description of the App

GiftLift: Free Gift Rewards is a serverless Shopify application that provides tiered free gift promotions, milestone progress bars, and interactive storefront theme blocks. The App executes discount calculation logic natively inside Shopify’s checkout environment using Shopify Functions (WebAssembly).

3. Merchant Obligations & Consumer Promotion Compliance

As a merchant utilizing GiftLift, you agree that:

• You are solely responsible for setting, validating, and managing spend thresholds, eligible gift inventory, and promotional messages displayed to your customers.
• You will ensure that all free gift promotions and advertised rewards comply with applicable consumer protection, truth-in-advertising, and promotional disclosure regulations in your relevant jurisdictions.
• You will verify that your inventory levels for reward items are adequate to fulfill promotional demand.

4. Software Availability & Platform Dependency

Because the App executes discount calculations natively through Shopify Functions and stores rules in Shopify Metafields, the operation of the App is dependent on the availability and performance of Shopify’s platform infrastructure. Pinetech ITS is not responsible for platform downtime, service interruptions, or API deprecations attributable to Shopify.

5. Intellectual Property

All title, ownership rights, and intellectual property rights in and to GiftLift, including code, design assets, and documentation, remain the exclusive property of Pinetech IT Solutions Private Limited. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely on your authorized Shopify stores.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Pinetech IT Solutions Private Limited, its directors, employees, or partners be liable for any indirect, incidental, punitive, or consequential damages (including loss of profits, revenue, or business interruption) arising out of or in connection with the use or inability to use the App.

7. Termination

You may terminate your use of the App at any time by uninstalling it from your Shopify admin panel. Upon uninstallation, all app session tokens are revoked, and data deletion occurs in accordance with our Privacy Policy.
